Orlando Weapon Offenses Attorney

In the state of Florida, the criminal penalties for a conviction of many weapon offenses are extremely harsh. In fact, you could face serious consequences including substantial fines, jail/prison time, a permanent criminal record, and damage to your career and reputation. One example of just how harsh the criminal penalties are is the possession of a gun at the time you allegedly committed a crime, which could be 10 years. At Adams, Luka, & Benton, our Orlando weapon offenses defense lawyers are dedicated to providing you with the skilled, aggressive legal representation you need to reach the best possible result.

The 10-20-Life Statute included in 775.087 was entered into Florida law in 1999. This statute stipulates that:

  • When an offender possesses a firearm/gun or other destructive device while committing or attempting to commit certain felonies, he/she will face a minimum prison term of 10 years
  • If the firearm is discharged, the minimum prison term will be 20 years
  • If someone is injured or killed by the firearm/weapon during the commission/attempted commission of the crime, the offender will face a minimum prison term of 25 years and maximum of life in prison
  • A convicted felon who is found in possession of a firearm will face a minimum of three years in prison
  • The minimum prison term will be served consecutively to any other imposed prison term

As you can see, the consequences of a conviction are extremely serious and will affect every aspect of your life.

I would like thank my attorney Thomas Luka. I knew from the beginning I had the right guy in my corner. While celebrating with family and friends at a Public Park in Seminole County, a fight broke out among various people. Myself, and a good friend, broke up the fight and the instigators left. Six months later, I was wrongly accused as the person who started the fight. The first attorney I hired could not even get a response from the State Attorney handling the case. Someone referred me to Tom and I felt comfortable at his demeanor and reactions.

After conversations with Tom, who knew I would settle for nothing less than a FULL DISMISSAL due to my innocence, I hired him. His firm Adams, Luka, & Benton did the due diligence by interviewing witnesses and the police who were on the scene, as well as starting a dialogue with the State Attorney. After gathering statements from witnesses, Tom was able to present a strong argument on my behalf to the State Attorney on why the case should be dismissed. If the State Attorney was not willing to dismiss the case, Tom was ready to take the case to trial.

The result by Thomas Luka: Case Dismissed.

I am 53 years old with a spotless record and glad to keep it that way thanks to the time, effort, hard work, and professionalism of Adams, Luka, & Benton.

Thomas Luka left a life-long great impression of lawyers. He was always professional, on time, and answered things honestly. From the start and during the 14 months it went on - Tom was very upfront and honest with me about the possible outcomes. The result was better than I had hoped for. Tom really over-delivered. HIGHLY RECOMMEND. Marcela Giorgi
