Although Deland is not a particularly large city with a population of just over 27,000, the crime rate is extremely high, both when compared with the state of Florida and the U.S. average. In most cities, theft-related crimes, burglaries, and assaults are the most common crimes individuals are charged with, however auto theft, arson, rape, and even murder occur as well. At Adams, Luka, & Benton, we know that when you are potentially facing criminal charges, it is a frightening experience regardless of whether the charge is carjacking, domestic violence, or something as seemingly minor as DUI. No matter what you are facing, we urge you to contact our firm now at (407) 872-0307.
The criminal penalties when convicted of a crime can be life-changing, stealing your freedom and damaging your career and reputation. Depending on the offense you are accused of, these penalties may include jail time or substantial prison time, fines, probation, community service, even driver's license suspension or court-ordered drug or alcohol counseling. However, you have legal rights, and are innocent until proven guilty. Our top priority is protecting your freedom and limiting the damage to your life.
With more than 30 years of combined experience, we have a proven track record representing clients charged with all types of crimes including:
As capable and experienced Deland criminal defense lawyers, we are highly familiar with the criminal justice system in central Florida. We know how aggressive police and prosecutors are, and the tactics they use to first charge an individual with a crime, then secure a conviction. Police must not violate your rights, however they often do. For example, a police officer may pull someone over for drunk driving even though he or she does not have reasonable suspicion to do so, which is required under the law. A search may be performed without the required warrant. We work vigorously on our client's behalf, investigating the charges against you, determining whether your rights may have been violated, examining the evidence, challenging the prosecutor's case, and developing a solid legal strategy in an effort to reach positive results. We will answer your questions and keep you informed throughout the process so that you always know where you stand, and what to expect next.

I would like thank my attorney Thomas Luka. I knew from the beginning I had the right guy in my corner. While celebrating with family and friends at a Public Park in Seminole County, a fight broke out among various people. Myself, and a good friend, broke up the fight and the instigators left. Six months later, I was wrongly accused as the person who started the fight. The first attorney I hired could not even get a response from the State Attorney handling the case. Someone referred me to Tom and I felt comfortable at his demeanor and reactions.
After conversations with Tom, who knew I would settle for nothing less than a FULL DISMISSAL due to my innocence, I hired him. His firm Adams, Luka, & Benton did the due diligence by interviewing witnesses and the police who were on the scene, as well as starting a dialogue with the State Attorney. After gathering statements from witnesses, Tom was able to present a strong argument on my behalf to the State Attorney on why the case should be dismissed. If the State Attorney was not willing to dismiss the case, Tom was ready to take the case to trial.
The result by Thomas Luka: Case Dismissed.
I am 53 years old with a spotless record and glad to keep it that way thanks to the time, effort, hard work, and professionalism of Adams, Luka, & Benton.
